The round-up from elsewhere finished, there are new developments in this case worth mentioning.

Two sentenced in beating of gay teen in Edgewood

Quote:
State District Judge Michael Vigil sentenced Cecily Gonzalez, 17, to a year in the custody of the Children, Youth and Families Department for taking part in the beating. Gonzalez, who faced a maximum of two years in CYFD custody, pleaded guilty to aggravated battery and false imprisonment but wasn't eligible for a hate-crime enhancement of an extra year because she was sentenced as a juvenile.

...

Uriah Smith, 18, pleaded guilty to conspiracy to commit kidnapping and was sentenced to four years in prison. Prosecutor Donna Dagnall said everyone involved identified Smith as the leader of the attack, though Smith's attorney said his client never battered the victim.

Ellen Russill, a juvenile probation officer, said a diagnostic exam on Smith found he has psychotic tendencies, possible personality disorders and wasn't amenable to treatment in the juvenile system.

Noting that Smith requested adult sanctions, Dagnall said Smith's report was one of the most frightening she'd ever read. She also said that Smith considered shoving a broomstick up the victim's rectum but decided against it because he thought people might consider him gay.

"There's something seriously wrong with Mr. Smith," Dagnall said. "He knows right from wrong and does wrong anyway."

The charges against two other defendents in the case are still pending.

Edgewood: Four indicted in gay-bashing case

Quote:
Four people accused of beating an 18-year-old gay man in Edgewood on July 30 were indicted Friday on hate-crime charges. A grand jury charged Cecily Gonzales, Leroy Segura, Uriah Smith and William York with kidnapping, aggravated battery, conspiracy and false imprisonment. An additional year of prison time can be imposed if a jury finds a defendant was motivated to commit a felony because of the victim’s characteristics, such as sexual orientation or race.

Note that the minors accused in this case, Cecily Gonzales (16) and Uriah Smith (17), have been indicted as adults. Leroy Segura is reportedly 19, while William York is 21.

Something that seems to have slipped everyone's notice is the judge in this case -- it's State District Judge Michael Vigil, whom we have read about before.

Quote:
The juvenile male arrested in the case said he, York and Segura tied the gay man's hands, placed a torn black T-shirt over his head, walked him into a deserted field, pushed him onto a downed fence and beat him, the statement says. The juvenile, the statement says, said he egged on York by calling the gay man joto, a derogatory Spanish word meaning gay.

While the Free New Mexican gets a kudo for printing the word (so many other news outlets are just too shy), I have to rescind it. "Joto" most assuredly does not mean "gay" in Spanish. It means "faggot." There is as much a difference between the two words in Spanish as there is in English.

A statement of probable cause, filed by the prosecutor in state District Court says York told police that he was told by Segura that the victim had tried to grab his butt.

York said he had not felt a grope but was upset by what Segura had told him.

The statement also says York told police that everyone at the party was making fun of the 18-year-old man because he was gay and that he wanted to "scare [him] to make him straight and to get him to stop acting the way he was.''

The statement goes on to quote from an interview given to police by the minor male in the case where the youth said he, York and Segura tied down the victim, placed a torn T-shirt over his face, dragged him to a deserted field and began beating him.

The juvenile allegedly told police that he egged on York by using Spanish homophobic slurs.

Update on the New Mexico case: More arrests

THE NEW MEXICAN

Quote:
Two more people allegedly involved in kidnapping, tying up and beating an 18-year-old gay man are in police custody.

Leroy Segura, 21, turned himself in at the Santa Fe County jail Monday and faces charges of kidnapping, aggravated battery causing great bodily injury, false imprisonment and conspiracy, state police Lt. Juan Martinez said. Cecily Gonzales, 16, was arrested Saturday and charged with kidnapping, conspiracy and aggravated battery, Martinez said.

The two join Uriah Smith, 17, and William York, 21, who face the same charges as Segura in connection with the beating, which allegedly took place July 30-31 after a house party in Edgewood.

The four allegedly kidnapped the man, tied him up and repeatedly beat him because he is gay, according to police, a prosecutor and court documents.

Smith and Gonzales are incarcerated at the Santa Fe juvenile jail while York is in the Metropolitan Detention Center in Albuquerque.

You may recall that this similarly hateful case also took place in Santa Fe, a tad over a year ago.

Police arrested William York, 21, and Uriah Smith, 17, and are looking for Leroy Segura, 18. York and Smith are being held without bond.

All three face charges of kidnapping, aggravated battery and false imprisonment.

The district attorney said he will seek hate-crime enhancements against the three which could mean an extra year on a sentence if convicted

Police say the victims are recovering at home.

The investigation also remains open, which means additional arrests are possible.

(The emphasis is mine.)

Wow. A whole extra year. Sure is a good thing New Mexico is one of the states with a hate crime law, isn't it?

Anglada said the attackers told the man “they were going to scare him straight.”

A spokesperson for the American Civil Liberties Union says she’s disgusted by the crime. “They were so hostile and so angry at the fact he was gay that they decided that beating this man almost to death was justified, which is crazy.”

Police have arrested William York, 21, and a minor in connection with the beating. They’re still looking for another man, Leroy Segura.

The minor’s mother says she doesn’t believe it was a hate crime. “We’ve got gay people in the family,” she said.

The victim’s family says they’ve received numerous threats since the beating.

May all the gods preserve me from str8 people.

Quote:
Three young men accused of brutalizing an 18-year-old gay man for hours last weekend have been charged with hate crimes, according to police, court documents and a prosecutor.

The men also allegedly kidnapped a woman, who was held in a camper and kicked and beaten while the man was repeatedly attacked late Saturday night and early Sunday morning after a house party in Edgewood, according to a search warrant filed Wednesday in state District Court in Santa Fe.

Prosecutor Donna Dagnall, who handles cases in Children's Court, said the 18-year-old man suffered bleeding on the brain and a concussion as well as facial lacerations and bruising, but has since been released from a hospital. Dagnall confirmed the three men allegedly responsible for the beating have been charged under New Mexico's hate-crimes law.

"It's pretty clear to us that his homosexuality was the reason for the beating," she said.

Uriah Smith, 17, and William York, 21, whose hometowns were not available Wednesday, have been arrested and each charged with two counts of kidnapping, aggravated battery causing great bodily injury, false imprisonment and conspiracy.

There is much more about this horrific case at the link. The details are just mind-boggling.

Well, to be accurate, it's not really a "gift", it's a reward -- a bounty, if you will.

The reward was NGLTF's in the first place as I understand it. The Triangle Foundation is not wealthy. A matching gift would explain it. Puzzling to me is the date on the press release -- the same as Triangle's original assertion that the amount was $5000.

In any event, I'm pleased the bastard has a price tag.

I don't know if it's an error, a miscommunication, or a change in plans, but NGLTF is using a different number when describing the reward they are offering than the Triangle foundation has been.

Quote:
WASHINGTON, March 29 — Detroit police have closed their investigation into the Feb. 23 death of Andrew Anthos, 72, after the Wayne County medical examiner’s office ruled Anthos fell because he had an arthritic neck, not because he was struck during a hate-motivated attack.

Anthos was left paralyzed from the neck down in what his family and others have called a hate crime. Anthos was on a city bus on Feb. 13 when a man reportedly approached him and asked him whether he was gay. The man reportedly continued to harass Anthos and followed him off the bus at the stop in front of his building. A witness saw a man trailing Anthos and standing over him while Anthos was face down on the ground. Anthos gave a corroborating statement before slipping into a coma. The medical examiner’s report fails to explain a 2-inch bruise on the back of Anthos’ head.

Statement by Matt Foreman, Executive Director
National Gay and Lesbian Task Force

“The Detroit Police Department’s mishandling of the investigation into the death of Andrew Anthos is appalling and it is clear that they simply want to sweep it under the rug. The DPD have failed on so many levels — they have failed to involve the community in finding additional witnesses, they have ignored Mr. Anthos’ family and they are using a coroner’s report to negate Mr. Anthos’ deathbed statements and those of an eyewitness.

“We’ve seen the same kinds of things happen time and again in the way in which police respond to hate violence against lesbian, gay, bisexual and transgender people. We are proud to work with the Triangle Foundation and to post a $10,000 reward to encourage people to come forward with information leading to the arrest and conviction of the perpetrator.

The emphasis is mine.

A small addition from Towleroad:

Quote:
The AP notes, "It was unclear what police made of the friend's account." It's also unclear where police came up with a sketch of Anthos' attacker which was released on March 1st.

Athena Fedenis, Anthos' cousin, whom police did not talk to before going public with their findings, expressed shock that the case was closed: "I'm just livid about this. Andrew didn't have any reason to make this up. I won't let this rest. I can't let this tarnish him. I don't want anyone to think it wasn't a hate crime."

The Triangle Foundation isn't quite buying it either.

Quote:
Today, Triangle Foundation joined with the Wayne County Prosecutor's office and the National Gay and Lesbian Task Force in calling for more witnesses to come forward in the attack on openly-gay 72-year-old Detroiter Andrew Anthos. The Task Force has offered a $5,000 cash reward for information leading to the arrest and conviction of a suspect in the case.

"Triangle Foundation stands in full support of the family of Andrew Anthos, whom we still believe was the victim of a vicious anti-gay assault which ultimately led to his death," said Triangle Director of Victims Services Melissa L. Pope, J.D. In addition to Andrew's statements about the attack to his family while on his deathbed, there was a witness present who provided police with a sketch of the man we believe attacked Andrew."

Triangle Foundation will continue working with Andrew's family and the press to reaffirm what we believe to be the truth in this case. The coroner's report, which we have not seen at this time, is unfortunate because it may lead to justice not being served in this case.

Wayne County Prosecutor Kym L. Worthy's office has issued a call for witnesses to call the Detroit Police Department. Triangle and the Task Force request that witnesses who may feel unsafe contacting the police call Triangle directly at 313-537-7000, ext. 112 or 1-877-787-4264.

Further, we request that everyone receiving this message forward it to everyone they know in the city of Detroit and/or anyone thay know who may have been in the city on the night of Feb. 13 who may have been a witness to this attack. Together, we will pursue justice in this case.

The emphasis is mine (the original statement contains emphasis of it's own that I did not reproduce).

Me too.

If memory serves, it came from Mr. Athos before his condition deteriorated.

"Likely" does not mean "did" (one of the reasons I use the word so often myself). Mr. Athos' version of events and the Medical Examiner's Office findings do not at all match up well. I am inclined to believe Mr. Athos and I am inclined to disbelieve the Medical Examiner. Mr. Athos had nothing to gain with his version of events and the City of Detroit does have something to gain with theirs.

Whaaaaaaaaaat?! Then just where did this story of a beating (with a lead pipe, no less) spring from? I smell something fishy here...

The AP is reporting that

Quote:
the Wayne County Medical Examiner's Office concluded that Anthos fell because he had an arthritic neck, and detectives were unable to find witnesses to a beating, police said. Medical Examiner Dr. Carl Schmidt said evidence did not support the report of an attack on Anthos and said a head injury likely came from falling.

Police: Man's death is not a hate crime

Quote:
DETROIT -- Andrew Anthos, the elderly gay man whose death was attributed to a vicious hate crime, did not die from a beating but from natural causes, Detroit police said Wednesday.

Police spokesman James Tate, citing an autopsy report from the Wayne County Medical Examiners Office that made the conclusion, said there was no evidence of a crime.

The autopsy's conclusion has angered Anthos' relatives.

"They determined that he died of natural causes," Tate said. "There's no evidence that an assault occurred. Effectively, this case is closed."
